We need to be aware of our own biases, especially when making decisions that are being regulated by law. Companies are always in search of top talent - however, the people that are making the decisions hold unconscious biases. There is this belief that women can not dedicate their time to work because of their obligations at home. This is a practice that discriminates against women in their workplace. This occurs more often when women pursue higher level positions such as in the C suite of an organization. These jobs have huge commitments and people see that women and their home life will conflict with their work. However, if decisions were being made based solely on their gender makes it illegal. Additionally, it handicaps the organization because it is not allocating its top talent where it is needed due to the fact that their top candidate is female.
